Terms of Service

1. Acceptance of Terms
By accessing or using the Jobee platform ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service. These Terms constitute a legally binding agreement between you and Jobee.
2. Eligibility
To use our Service, you must be at least 14 years of age. If you are under 18 years old, you represent that you have your parent or guardian's permission to use the Service and that they have read and agreed to these Terms on your behalf. Employers must be at least 18 years old and have the legal authority to hire workers.
Parental Consent for Minors: During account registration, users under 18 must provide a parent or guardian's email address. We will send a consent notification to this email requiring parental acknowledgment of these Terms and our Privacy Policy. We may verify parental consent through additional methods including email verification, consent forms, or other reasonable means. Accounts created by minors without proper parental consent may be suspended or terminated.
Quebec (CNESST) — Minimum Working Age & Young Worker Rules
For jobs located in Quebec, the Act respecting labour standards and the CNESST (Commission des normes, de l'équité, de la santé et de la sécurité du travail) set a minimum working age of 14. Children under 14 may only work in specific exempt roles (such as babysitting, tutoring/homework help, newspaper delivery, certain family-business, non-profit, sports or light agricultural work) and only with the written consent of the holder of parental authority using the CNESST consent form. Children under 14 in exempt roles (other than babysitting, tutoring and newspaper delivery) must work under the supervision of a person 18 years of age or over at all times.
For any young person subject to compulsory school attendance (generally until the end of the school year in which they turn 16), employers must ensure the work schedule:
- does not exceed 17 hours per week, with a maximum of 10 hours from Monday to Friday (this limit does not apply during school breaks of more than 7 consecutive days);
- allows the young person to attend school during school hours;
- allows the young person to be at home between 11 p.m. and 6 a.m. (with limited exceptions provided by law); and
- does not involve work that is disproportionate to the child's capacity or detrimental to their education, health, or physical or moral development.
Employers posting jobs in Quebec are solely responsible for obtaining any required parental consent, respecting these schedule limits, and complying with all CNESST and occupational health and safety requirements for young workers. Massachusetts (Boston area) — Youth Employment & Work Permits
For jobs located in Massachusetts, the Massachusetts Attorney General's Fair Labor Division and the Federal Fair Labor Standards Act (FLSA) set youth employment rules. Youth aged 14–15may work only in limited non-hazardous jobs, with restricted hours (e.g., max 3 hours/day on school days, 18 hours/week during school weeks, no work before 7 a.m. or after 7 p.m. during the school year). Youth aged 16–17may work expanded hours but are still barred from hazardous occupations. Massachusetts requires a work permit for all minors under 18, issued by the school district where the minor resides or studies. Employers must keep the work permit on file during the entire employment and must return it to the issuing school within two days of termination.
Employers posting jobs in Massachusetts are solely responsible for verifying the applicant's age, obtaining and keeping the required youth employment permit (work permit), complying with all hour and hazardous-work restrictions, and meeting the Massachusetts minimum wage for all hours worked. Failure to comply may result in fines and penalties under Massachusetts law. More information: Mass.gov — Youth Employment.
California (Bay Area) — Child Labor & Worker Classification
For jobs located in California, the California Labor Code and U.S. FLSA set the rules for youth employment. Youth aged 14–15 may work limited hours (no more than 3 hours/day on school days, 18 hours/week during school weeks, 8 hours non-school days, 40 hours non-school weeks, no work before 7 a.m. or after 7 p.m. year-round). Youth aged 16–17 may work up to 4 hours on school days and 8 hours on non-school days, 48 hours/week, and no work between 10 p.m. and 5 a.m. (with exceptions). California generally requires a Permit to Employ and Work for minors, issued by the school district.
Worker Classification (AB 5): California's Assembly Bill 5 (AB 5) presumes a worker is an employee unless the hiring entity can satisfy the "ABC test." Students performing work found on Jobee are intended to be independent contractors of the employer, NOT employees of Jobee. Employers in California are solely responsible for correctly classifying workers, complying with AB 5, and meeting all wage, hour, workers' compensation, and tax obligations. Jobee does not control or determine worker classification.
Employers posting jobs in California are solely responsible for verifying age, obtaining required work permits, complying with all hour and hazardous-duty restrictions, paying the applicable minimum wage, and correctly classifying workers under AB 5. 3. Account Registration and Security
To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You are solely responsible for safeguarding your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. Jobee will not be liable for any losses arising from unauthorized use of your account.
3.1 SMS / Text Message Notifications
When you provide a mobile phone number during registration, you agree to receive automated SMS/text message notifications from Jobee about your account and applications — including new matching job opportunities, application status updates (accepted/rejected), new applications received (for employers), and testimonial requests. These messages are sent via our third-party SMS provider, Twilio. Message frequency varies based on your activity (typically a few messages per week).
Consent & Opt-Out: By checking the SMS opt-in box at signup you consent to these texts. You can withdraw consent at any time by replying "STOP" to any Jobee SMS, by toggling SMS notifications off in your account settings, or by contacting us at contact@jobee.work. Opting out of SMS does not affect other notifications or your ability to use the Service.
Message Rates: Standard message and data rates may apply based on your mobile carrier plan. Jobee does not charge for SMS. You are responsible for any carrier charges.
4. Description of Service and Nature of Relationship
Jobee is an online platform that connects student job seekers with employers offering part-time, temporary, and entry-level employment opportunities. Our Service includes:
- Job posting and application management tools
- Job proposal system allowing employers to directly propose opportunities to students
- Messaging and communication features between users
- Profile creation and management
- Job search and filtering capabilities
- Review and rating systems
- Optional premium features including job boosting
- Notification and alert systems
Jobee acts solely as a platform to facilitate connections and is not an employer, employment agency, or staffing service. We do not guarantee employment outcomes, job quality, safety, or legality.
⚠️ Independent Contractor Relationship - Critical Disclaimer
Students who perform work through jobs found on Jobee are independent contractors of the employers, NOT employees, agents, or contractors of Jobee. Jobee is not a party to any employment relationship, agreement, or transaction between users. We have no control over: (a) the work performed; (b) working conditions; (c) compensation arrangements; (d) employer conduct; (e) student performance; or (f) any other aspect of the employment relationship. Any employment relationship, contractual obligations, disputes, injuries, damages, or legal issues are solely between the student and the employer. Jobee is not responsible for and expressly disclaims all liability for: wages, benefits, taxes, workers' compensation, unemployment insurance, liability insurance, workplace safety, discrimination, harassment, or any other employment-related obligations or violations. Students are not entitled to any employee benefits from Jobee.
5. User Conduct and Responsibilities
You agree that you will not:
- Post false, inaccurate, misleading, defamatory, or fraudulent content
- Violate any applicable local, state, national, or international law or regulation
- Post job listings that violate labor laws, including minimum wage requirements or child labor laws
- Harass, threaten, stalk, or intimidate other users
- Impersonate any person or entity or misrepresent your affiliation
- Collect or store personal data about other users without their consent
- Use the Service for any illegal or unauthorized purpose
- Transmit viruses, malware, or any other malicious code
- Attempt to gain unauthorized access to our systems or other users' accounts
- Interfere with or disrupt the Service or servers connected to the Service
- Use automated means (bots, scrapers) to access the Service without permission
- Post spam, chain letters, pyramid schemes, or unsolicited advertising
- Discriminate against any user based on race, gender, religion, nationality, disability, sexual orientation, or age
6. Job Posting Guidelines and Cancellations
Employers posting jobs on Jobee must ensure that:
- All job postings are for legitimate employment opportunities
- Postings comply with all applicable employment and labor laws
- Compensation details are accurate and comply with minimum wage laws
- Age requirements comply with child labor laws in your jurisdiction
- Postings do not require applicants to pay fees or make purchases
- Work environments are safe and appropriate for the stated age requirements
- Quebec (CNESST): For jobs located in Quebec, employers comply with the minimum working age of 14, obtain written parental consent for any permitted worker under 14, respect the 17-hour weekly limit (max 10 hours Monday–Friday) and the 11 p.m.–6 a.m. restriction for young persons required to attend school, and meet all CNESST young-worker and occupational health & safety obligations
- Massachusetts: For jobs located in Massachusetts, employers obtain and keep on file a youth work permit for any minor under 18 (issued by the school district), verify the applicant's age, comply with all FLSA and MA hour restrictions (3 hrs/day & 18 hrs/week for 14–15 year-olds during school weeks), avoid hazardous occupations, and pay the applicable Massachusetts minimum wage
- California: For jobs located in California, employers obtain a Permit to Employ and Work for any minor, verify age, comply with all California Labor Code and FLSA hour restrictions, avoid hazardous-duty occupations, pay the applicable California minimum wage, and correctly classify workers under AB 5 (students are intended to be independent contractors of the employer, not employees of Jobee)
- Timely and Full Payment of Wages: Employers must pay all agreed wages on time, in full, and in the correct amount, in accordance with applicable wage-payment laws (including, where relevant, the California Labor Code, the Massachusetts Wage Act, and Quebec's Act respecting labour standards regular-payday rules). Jobee does not process, hold, guarantee, or enforce payment between users and is not liable for late, partial, or non-payment by employers.
- Workers' Compensation and Insurance: Employers are solely responsible for determining whether they are legally required to carry workers' compensation insurance or other liability insurance for the workers they hire (note: California generally requires workers' compensation coverage even for some independent contractors, and Massachusetts and Quebec have their own mandatory coverage rules). Employers must obtain and maintain any insurance required by the jurisdiction where the work is performed. Jobee does not provide, arrange, or verify any such insurance and disclaims all liability for an employer's failure to carry required coverage.
Jobee reserves the right to remove any job posting that violates these guidelines or our community standards, without notice or refund.
6.1 Cancellation and No-Show Policy
Reliability is essential to our platform. We reserve the right to charge cancellation fees or suspend/terminate accounts for frequent cancellations or "no-shows." This applies to both students and employers:
- Student No-Shows: Failing to appear for a confirmed job without adequate notice (minimum 24 hours) may result in penalties, negative reviews, and account restrictions
- Employer Cancellations: Canceling a job after a student has confirmed availability (especially with less than 24 hours notice) may result in penalties and account restrictions
- Emergency Exceptions: We understand emergencies happen. Contact support immediately if you have a legitimate emergency preventing you from fulfilling a commitment
Specific fee amounts and penalty structures are maintained in our Help Center and may be updated without modifying these Terms.
7. Fees, Payment, and Tax Responsibility
Basic use of Jobee is free. Certain premium features, such as job boosting, require payment. All fees are stated at the time of purchase and are non-refundable unless otherwise specified. Payments are processed through secure third-party payment processors (Stripe). By making a purchase, you agree to the payment processor's terms of service.
Tax Responsibility
Users are solely responsible for all tax obligations related to income earned through Jobee.This includes reporting income to the appropriate tax authorities and paying any applicable federal, state, or local taxes. Jobee does not withhold taxes from payments, provide tax advice, or issue tax forms (such as 1099 forms) unless legally required. Students and employers should consult with a tax professional regarding their specific tax obligations. Failure to comply with tax laws is the user's responsibility, and Jobee is not liable for any tax-related penalties or interest.
8. Intellectual Property
The Service and its original content (excluding user-generated content), features, and functionality are owned by Jobee and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service without written permission.
9. User Content
You retain ownership of content you submit to the Service. By posting content, you grant Jobee a non-exclusive, worldwide, royalty-free license to use, display, reproduce, and distribute your content in connection with operating and improving the Service. You represent that you have all necessary rights to grant this license and that your content does not infringe on any third party's rights.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is harmful to our business interests. Upon termination, your right to use the Service will immediately cease. You may also delete your account at any time through your account settings.
11. Disclaimers and Assumption of Risk
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. JOBEE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, ERROR-FREE, OR FREE FROM VIRUSES OR OTHER HARMFUL COMPONENTS.
Jobee does not screen, verify, validate, or guarantee the accuracy, completeness, or reliability of user profiles, job postings, applications, reviews, or any user-generated content. We do not guarantee the quality, safety, legality, or suitability of jobs posted, the qualifications or character of applicants, or the ability or intent of employers to offer job opportunities or pay agreed compensation.
⚠️ CRITICAL SAFETY DISCLAIMER - NO BACKGROUND CHECKS OR SCREENING
Jobee does NOT conduct criminal background checks, sex offender registry checks, employment history verification, reference checks, credential validation, or any other form of user screening or vetting. While Jobee may offer optional identity verification services (such as ID document verification), these services only confirm that a user has access to an identification document and do NOT constitute background checks, safety screening, or any guarantee of user trustworthiness, character, or safety.
Parents, guardians, and students are solely and exclusively responsible for:
- Conducting independent background checks and research on all employers, job opportunities, and work environments
- Verifying the legitimacy, safety, and suitability of any employer or job
- Meeting employers in person in safe, public locations before accepting jobs
- Visiting work locations and assessing workplace safety
- Checking references and online reviews of employers
- Ensuring compliance with child labor laws and work permit requirements
- Supervising and monitoring all employment activities involving minors
- Reporting any suspicious, unsafe, or illegal activities to appropriate authorities
JOBEE IS NOT RESPONSIBLE FOR AND EXPRESSLY DISCLAIMS ALL LIABILITY FOR ANY HARM, INJURY, ASSAULT, THEFT, FRAUD, DISCRIMINATION, HARASSMENT, ABUSE, EXPLOITATION, DEATH, PROPERTY DAMAGE, FINANCIAL LOSS, EMOTIONAL DISTRESS, OR ANY OTHER DAMAGES WHATSOEVER (INCLUDING BUT NOT LIMITED TO PHYSICAL, PSYCHOLOGICAL, ECONOMIC, OR REPUTATIONAL HARM) RESULTING FROM OR RELATED TO: (a) interactions between users on or off the platform; (b) any employment relationship, agreement, or arrangement made through the platform; (c) workplace conditions, safety hazards, or accidents; (d) employer misconduct, negligence, or criminal activity; (e) student misconduct, negligence, or criminal activity; or (f) any other activity, event, or circumstance connected to use of the platform or jobs found through the platform.
⚠️ Assumption of Risk
By using Jobee, you acknowledge and expressly assume all risks associated with connecting with strangers, visiting unfamiliar locations, accepting employment opportunities, and engaging in work activities arranged through the platform. You understand that Jobee cannot and does not guarantee user safety, honesty, reliability, legality, or trustworthiness. USE OF THE PLATFORM IS ENTIRELY AT YOUR OWN RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL JOBEE, ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, PARTNERS, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL; COST OF SUBSTITUTE SERVICES; PERSONAL INJURY; PROPERTY DAMAGE; EMOTIONAL DISTRESS; REPUTATIONAL HARM; LOST OPPORTUNITIES; OR ANY OTHER DAMAGES WHATSOEVER ARISING FROM OR RELATED TO: (A) YOUR USE OF OR INABILITY TO USE THE SERVICE; (B) ANY INTERACTIONS, TRANSACTIONS, OR RELATIONSHIPS WITH OTHER USERS; (C) ANY EMPLOYMENT ARRANGEMENTS MADE THROUGH THE PLATFORM; (D) UNAUTHORIZED ACCESS TO YOUR ACCOUNT OR DATA; (E) ERRORS, MISTAKES, OR INACCURACIES IN CONTENT; (F) ANY VIRUSES OR MALICIOUS CODE; OR (G) ANY OTHER MATTER RELATED TO THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), PRODUCT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT JOBEE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
JOBEE'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATED TO THESE TERMS OR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO JOBEE IN THE PAST 12 MONTHS; OR (B) ONE HUNDRED DOLLARS ($100 USD).
Jobee is not responsible for and has no liability whatsoever for: any interactions, communications, agreements, arrangements, transactions, payments, disputes, injuries, damages, losses, or any other matters occurring between users, whether on or off the platform. Any employment relationship, contract, or arrangement formed through the Service is solely and exclusively between the employer and the student. Jobee is not a party to any such relationship or transaction.
Jobee is not responsible for and expressly disclaims all liability for non-payment or underpayment by employers. Students are solely responsible for negotiating, confirming, and collecting payment directly from employers. Jobee does not guarantee, facilitate, process, or enforce any payment between users. Students are strongly advised to confirm payment terms in writing before beginning any work.
12.1 Disputes Between Users
If a dispute arises between a student and employer regarding work quality, payment, job expectations, or any other matter related to a job found through Jobee:
- Direct Resolution Encouraged: Users are encouraged to resolve disputes directly and amicably
- Optional Mediation: Jobee is not a party to any dispute but may, at its sole discretion, offer to mediate or provide guidance. Jobee has no obligation to intervene
- Platform Decision is Final: If Jobee does choose to intervene (for example, to issue a refund, remove a review, or impose penalties), Jobee's decision is final and binding. Users waive the right to dispute Jobee's mediation decisions
- No Liability: Jobee is not liable for any damages resulting from user disputes, including non-payment, poor work quality, or breach of agreement
Users are responsible for documenting work completed, payment terms, and any agreements made. We recommend keeping all communications on-platform where they can be reviewed if needed.
13. Indemnification
You agree to indemnify, defend, and hold harmless Jobee, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorneys' fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of another party.
14. Dispute Resolution
Any disputes arising from these Terms or your use of the Service will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration shall take place in Newton, Massachusetts. You agree to waive your right to a jury trial or to participate in a class action lawsuit. This arbitration agreement does not preclude you from seeking relief in small claims court for disputes within its jurisdiction. Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect intellectual property rights, confidential information, or to prevent irreparable harm, without waiving the right to arbitrate all other claims.
15. Modifications to Terms
We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after changes are posted constitutes your acceptance of the modified Terms.
16. Governing Law and Jurisdiction-Specific Compliance
These Terms shall be governed by and construed in accordance with the laws of the State of Massachusetts, without regard to its conflict of law provisions. Any legal action not subject to arbitration shall be brought exclusively in the state or federal courts located in Middlesex County, Massachusetts.
Local Labor Law Compliance: Jobee operates in multiple cities, states, and provinces — including Montreal (Quebec, Canada), the Boston area (Massachusetts, USA), and the San Francisco Bay Area (California, USA). Labor, employment, child labor, minimum wage, and worker classification laws vary significantly by jurisdiction. Nothing in these Terms overrides or limits the application of mandatory local laws protecting workers, including minors. Employers are solely responsible for complying with the labor laws of the jurisdiction where the work is actually performed, regardless of where the employer or student is located. Jobee does not provide legal advice and cannot verify employer compliance with local laws.
To the extent any local consumer or labor protection law (including Quebec's Act respecting the protection of consumers, California's Consumer Legal Remedies Act, or Massachusetts consumer protection law) applies to a particular user or transaction, nothing in these Terms is intended to waive rights that cannot be waived under those laws.
17. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
